Terms and Conditions

 Stone Metal Products, Inc. agrees to sell the products covered herein on the following Terms and Conditions. Additional Terms and Conditions not covered herein will be accepter upon mutual agreement in writing.

ACCEPTANCE: All orders are subject to credit approval and final acceptance by STONE METAL PRODUCTS, INC., Houston, Texas.

PRICES: Quotations are valid for thirty days unless otherwise stated in writing and are subject to withdrawal or change at any time prior to final acceptance and acknowledgement by STONE METAL PRODUCTS, INC. Prices are F.O.B. Houston Plant. STONE METAL PRODUCTS, INC. reserves the right to invoice customer for any or all finished material ready for shipment, when held at customers request or because of other reasons beyond STONE METAL PRODUCTS, INC.’s control. Every Sales Tax or other Excise, which STONE METAL PRODUCTS, INC. may be required by law to pay on or in connection with the sale will be added to the price quoted and STONE METAL PRODUCTS, INC. reserves the right to bill such expense at the time of invoicing material or any subsequent time without forfeiture of collection rights. All orders are subject to any Federal, State or other Governmental regulation that may be in effect or later become effective. Typographical and clerical errors in quotations or orders are subject to corrections. CANCELLATIONS: Orders accepted shall not be subject to cancellation except on terms that shall protect STONE METAL PRODUCTS, INC. from loss.

SHIPMENTS AND DELIVERY: Shipping dates are approximate and based upon prompt receipt of all necessary information by STONE METAL PRODUCTS, INC.

STONE METAL PRODUCTS, INC. shall not be liable for delays in manufacture or delivery of its reasonable control. All good are shipped at the purchaser’s risk. While every reasonable precaution is taken in packing, the Company is NOT RESPONSIBLE for good damaged or lost in transit. Claims to recover such loss or damage must be filed with the carrier by the purchaser. Items offered from stock are subject to prior sale.

WARRANTY: Products manufactured by STONE METAL PRODUCTS, INC. are guaranteed free from defects in material and workmanship to the original purchaser for a period of one year from the date of shipment. Our liability is limited to the replacement or repair of products found by our inspection to be defected upon receipt F.O.B. our factory. In no event shall the Company be liable for consequential damage. No agent or representative is authorized to assume for the Company any liability except as above set forth.

RETURN OF MATERIALS: Materials may be returned for credit only after authorization has been obtained from STONE METAL PRODUCTS, INC. and shall be subject to handling charges to be determined by STONE METAL PRODUCTS, INC.

INSPECTION: Final inspection and acceptance of products must be made at STONE METAL PRODUCTS, INC. plant and shall be conclusive except as regard latent defects. Customer’s representatives may inspect at the plant during normal business hours prior to shipment in such manner as will not interface with operations.

DESIGN: Because of a policy of continuous products improvement, STONE METAL PTODUCTS, INC. reserves the right to change designs, materials, or specifications without notice.
